Access political asylum
Access political asylum or defensive asylum if you are in removal (deportation) proceedings in immigration court with the executive office for immigration review (EOIR), with the judge deciding whether the person is eligible and if it is granted by the same.
Affirmative asylum is the option if not in removal proceedings, the person must be in the United States for the application, regardless of their entry into the country.
